The website is operated by Blacker The Berry Ltd, a company registered in England and Wales under company number 12555575 with its registered office at Blacker The Berry Parties International House, 12 Constance Street, London E16 2DQ, United Kingdom. (Blacker The Berry Parties)

Please read these Terms and Conditions carefully. Please print a copy for your own records. These Terms and Conditions are set out in three parts:

Part 1 Website Terms and Conditions: this section is relevant to persons who make use of the services made available by Blacker The Berry Parties on the website and who sign up to become registered users (including verified registered users) of website.

Part 2 Association Terms and Conditions: this section is relevant to persons that become, or would like to become, members of Association ("Members") and to guests of members ("Guests") when they make use of the services offered, and events and parties hosted, by the Association.

Part 3 General Terms: This section covers general terms that apply to the matters referred to in both Part 1 and Part 2.

Blacker The Berry Parties takes the protection of your personal data seriously. Please see Blacker The Berry Parties Privacy Policy, which forms part of these Terms and Conditions, for details of how Blacker The Berry Parties will use and process your personal data.

1.1 USE OF WEBSITE AND ONLINE SERVICES

These Website Terms and Conditions ("Web Terms") apply to our access and use of the Website and the products and services made available by Blacker The Berry Parties through our Website (the "Online Services). By accessing the Website and using the services you agree to be legally bound by these Web Terms.

Blacker The Berry Parties may update these web terms in the future and for legal or regulatory reasons, or to upgrade our services. We will inform you if any of these changes will affect you. Please regularly check our terms and conditions to keep updated with our changes.

If you are a fee-paying verified member of our website, any changes to the Web Terms will be in effect from the date of your next payment. If you are not a fee-paying verified member the Web Terms changes will be in effect as soon as Blacker The Berry Parties makes any changes. We will notify you if our changes will affect you in any way.

If you continue to use Blacker The Berry Parties website and services, you will be deemed to have accepted our amended services. If you do not agree to the amendments, you should stop using the Website and all our online services.

1.2 DIFFERENCE BETWEEN FREE ACCESS USERS AND BASIC VERIFIED MEMBERSHIP.

Blacker The Berry Parties has 2 types of users. Those who have no membership and are not verified will not be invited to any of our Adult parties, They can attend our workshops. No access to our forum will be available.

Those who have been verified will have full access to the website, our forum and notification about our adult parties. Any member can attend a workshop,

Tickets for our parties are only for verified members. Anyone wishing to attend our parties must register their details on our website. Please see 1.3 of these terms Web Terms to find out how to become a member.

1.3 BECOMING A VERIFIED BLACKER THE BERRY PARTIES MEMBER

All are welcome to register to become a member of our Website and have access to our community, We charge for the application fee to cover the costs of vetting your application, ID checks and other administration costs. This fee is non-refundable.

To become a member you must register via our website www.blackertheberryparties.co.uk

Not all applications will be accepted. There is no guarantee that verified members will be invited to all our parties,

1.4 CONDITIONS OF REGISTRATION, CODE OF BEHAVIOUR, CONFIDENTIALITY AND CONTENT POLICY

When you apply to become a member of Blacker The Berry Parties, you must be 18 years old or over and may be asked for proof of your identity and a picture so that Blacker The Berry Parties can verify that you are a real person. If Blacker The Berry Parties believes that you are not a real person, Blacker The Berry Parties reserves the right to make your registration conditional on you becoming a Blacker The Berry Parties member.

Blacker The Berry Parties operates a strict Code of Behaviour of all its members. You must read the Code of Behaviour before registering as a Blacker The Berry Parties member and must comply with it all times when using the Website and our online services including any interaction with all the other members.

Privacy, confidentiality and discretion are imperative Blacker The Berry Parties requires all members to abide by. Do not discuss or disclose any non-public information about our members to anyone else.

You must not allow any other person to access your Blacker The Berry Parties account and/or use your login or password.

Blacker The Berry Parties reserves the right to accept or reject any application to become a verified member in its absolute discretion.

1.5 PAYMENTS AND AUTO-RENEWAL

Blacker The Berry Parties registration Fees are payable in advance.

Your Blacker The Berry Parties registration will automatically renew and your chosen payment method will be automatically recharged at the end of each Registration Period unless you choose to terminate your registration in accordance with Section 1.6 (Cancellation, Termination and Refunds).

1.6 CANCELLATION AND REFUNDS

When you apply to register you immediately agree to receive the Online Services available under that registration type.

As a consumer, you have the right to cancel your digital subscription within fourteen (14) days from your purchase date. (the “Cancellation Period”)

To exercise your right to cancel your membership, you must within the fourteen (14) day Cancellation Period, contact Blacker The Berry Parties at info@blackertheberryparties.co.uk with a notification clearly stating your decision to cancel your registration. Please include details of your name, email address and user name so that Blacker The Berry can identify your account. A £10 admin fee will apply

You have the right to terminate your membership at any time. Please sent Blacker The Berry Parties an email to info@blackertheberryparties.co.uk

Please include your name, username and email.
Termination by you will take effect at the end of the then-current Registration Period.

Blacker The Berry Parties may terminate your membership at any time if in its reasonable opinion you have breached any of these Web Terms, including the Code of Behaviour or anything set out in these Web Terms, or any other terms that relate to your registration. In such circumstances, the termination will take effect immediately and you will not be entitled to any refunds.

Once your refund has been granted you will no longer have full access to Blacker The Berry Parties website. You will not be able to attend our parties.

Blacker The Berry Parties will delete all content and personal details linked to your account.

1.7 YOUR CONTENT/USER CONTENT

Your Content must comply with the Content Policy and the Code of Behaviour.

You take full responsibility for any of Your Content. You own the intellectual property and other rights in Your Content

Blacker The Berry Parties can not guarantee the accuracy or quality of any of User Content posted on or sent via Blacker The Berry Parties. While Blacker The Berry Parties endeavour to enforce the rules set out in these Web Terms, Blacker The Berry Parties does not promise to monitor or moderate User Content published on or sent via the Website.

Further, we are not responsible for the views in or otherwise in any way for any User Content.

If you believe that any User Content published on or made available via Blacker The Berry Parties fails to comply with these Web Terms, you can notify Blacker The Berry Parties by emailing us at info@blackertheberryparties.co.uk.

Upon receiving any complaints about User Content, we will review the User Content in question and may then decide to remove or edit it.

1.8 AVAILABILITY OF THE WEBSITE AND ONLINE SERVICES

The Website and Online Services are available on a temporary basis. Blacker The Berry Parties may update the Website and may change the Content and Online Services at any time.

Blacker The Berry Parties reserves the right to withdraw or amend the Website and/or Online Services at any time and without notice.

Blacker The Berry Parties will not be liable to you for any resulting loss or damage (to the extent Blacker The Berry Parties is allowed to restrict liability by law) if the Website or the Online Services are unavailable at any time for any period – unless you are a Fee-paying member in which case Blacker The Berry Parties may reimburse you accordingly.

You are responsible for making all arrangements necessary to access the Website and Online Services.

Use of the Website and Online Services may be subject to your computer and/or device complying with minimum standard technical specifications and compatibility requirements Blacker The Berry Parties shall not be liable for any failure due to any incompatibility (including, without limitation, minimum storage and memory requirements from time to time).

2.GUEST AND NON-MEMBERS

No guest is allowed to attend our parties without becoming a verified member, All attendees must be Blacker The Berry Parties members, Only verified members will be invited to Blacker The Berry Parties events.

If a member fails to follow this guideline both the member and their guest will not gain entry to our party and the member will have their membership revoked of immediate effect. No refund will be granted.

Our parties are exclusive. The location of a Blacker The Berry Party will be given 6 hours before the event starts, It is prohibited to share this information with anyone who is not a verified member.

2.1 ACCEPTANCE OF APPLICATION

To meet the objects of the Association, you can apply to become a Member if you satisfy all of the following eligibility criteria:

you are attracted to Black women
you are aged 18 years old or over;
you are registered as a Blacker The Berry Parties member on the Blacker The Berry Parties Website; and
you have received a verified membership status,

Please do not apply to become a Member unless and until you satisfy the Eligibility Criteria.

There is an application charge to become a Member to cover the costs of assessing and vetting your application, ID checks and other administration costs. This fee is non-refundable.

To apply to become a Member, please complete and submit the verification process inside the website.

2.3 TICKETS AND ACCESS TO PARTIES AND EVENTS

ID must be provided to enter. NO ID/NO ENTRY, No refund will be granted.

Please print your ticket/s or have your downloaded code ready for entry. NO TICKET/NO ENTRY,

You are responsible for your safety and belongings. Blacker The Berry Parties in not liable for your belongings or the choices you make.

2.4 TERMINATION OF MEMBERSHIP AND EXPULSION

A Member shall be entitled to terminate their membership of the Association at any time by emailing info@blackertheberryparties.co.uk

The Management Committee reserves the right to expel any Member, without prejudice to that person’s continuing Blacker The Berry Parties registration in respect of the Website, if the Management Committee determines, in its absolute discretion, that the Member has violated these Association Terms, including the Party and Event Policy (incorporating the Code of Behaviour).

3.GENERAL TERMS

3.1 DISCLAIMERS

Whilst Blacker The Berry Parties does its best to vet applicants for members registration and applications for Verified status, to check that they are real persons and/or to verify their real identity, Blacker The Berry Parties does not perform any other background checks (such as criminal record checks or sexual health), nor does it interview or actively vet or select members.

Blacker The Berry Parties will endeavour to provide a safe and respectful online and real-world environment for its members. However, Blacker The Berry Parties cannot control the behaviour of other members, Members and you are urged at all times to take care and be sensible in your interactions with other members, Members, in particular as regards to your safety and sexual activity. You are solely responsible for your interactions with other members, Members and for your safety. Blacker The Berry Parties are not responsible for the conduct of any Members or their User Content.

CODE OF BEHAVIOUR

As a registered member, you acknowledge and agree to comply with the following rules of behaviour:

act honestly and respectfully to others at all times;
be discrete at all times and respect other people’s confidentiality and privacy;
do not harass, abuse or harm another person;
comply at all time with the Blacker The Berry Parties on terms (if applicable) and all applicable laws, regulations, rules and directions;
do not use an image that is not your likeness for your profile;
do not misrepresent your relationships with a person or entity, past or present;
provide accurate information to Blacker The Berry Parties.
do not use images or terms in your descriptions or Blacker The Berry Parties profile that are offensive, obscene, pornographic, indecent, malicious, threatening, abusive, defamatory or otherwise unlawful;
do not create a profile for anyone other than yourself;
do not use or attempt to use another members account or impersonate another member;
do not collect or store another member personal data without their knowledge;
permanently delete and erase another member personal data on request of that other Kitten;
do not interfere or violate a third party’s private life, interfere with their private communications, or breach any duties of confidence or confidentiality;

PARTY AND EVENT POLICY

ADMISSION

Respect other members at all times
You are responsible for your actions
You are responsible for your belongings
No refunds for any of our events
Drugs are prohibited from our events
Consent is imperative
Hygiene is imperative
These events are here to encourage a positive sexual experience for Black women.

MOBILE PHONES

Members shall not take or make phone calls, and shall ensure that phones are in silent mode, whilst at a Party. Phones may only be used in designated areas.

CAMERAS/RECORDING DEVICES

No cameras, video or recording devices, live-streaming or otherwise – whether on a mobile phone or other device, may be used at a Party. The Management Committee reserves the right to take possession of and confiscate any mobile phone, camera, video or recording device and any photos, videos or other recorded images used or taken at a Party.

DRUGS AND SMOKING

Members and Guests shall not bring alcohol or illegal substances onto Party premises. Licensing laws shall be strictly enforced. Anyone who is or appears to be intoxicated shall be removed from the Party immediately without any entitlement to a refund.

Parties will in general be non-smoking and non-vaping events. Please follow directions at Parties to find designated smoking areas.
